Chapter 194, Article II, Parklets (adopted 2018 by Ord. No. 2149-18), defines a parklet as "a temporary curb extension in place of one or more on street parallel parking spaces" used for outdoor dining (§ 194-7). Section 194-8 limits eligibility to property owners fronting Market Street in the Passaic Bistro District and Broadway in the Eateries on Broadway District, and § 194-9 makes operating a parklet in either district without a license unlawful. The application under § 194-10 must go to the Municipal Clerk with a development plan, seating capacity, dimensions, insurance, indemnification and maintenance agreements, and the license fee.
Section 194-12 requires $1,000,000 combined-single-limit liability coverage and $10,000 in property-damage coverage; § 194-15 sets the annual fee at $250; and § 194-16 runs the license from May 1 through November 1, renewable annually. during the May-to-November season, and require furniture removal within 30 minutes of closing. Section 194-17Q additionally caps the total number of parklets in each district at no more than 10% of that district's available parking spaces.
Violations & Fines
Under § 194-19, if a City officer finds a parklet licensee has violated the article, the officer must give written notice requiring correction within 24 hours, filed with the Municipal Clerk. If the licensee fails to cure within that window, the Municipal Clerk revokes the license outright. A revoked licensee may request a hearing before the City Council, which must be held within 14 days of the request.
