Frederick, MD Special Events & Permits: Sidewalk Dining & Cafés (2026)

Chapter 22, Article VII (§§ 22-67 through 22-76) governs sidewalk cafes and applies only to restaurants in the downtown commercial/residential (DB) zoning district. A cafe may sit against the building facade or against the curb, and may extend onto a neighbor's sidewalk frontage with that owner's written permission. Section 22-71 requires a clear path of travel at least 5 feet wide between the cafe and the curb or building facade, plus 8 feet of unobstructed overhead height, and bars any cafe from the defined "clear zone" at crosswalk landing areas.

Section 22-72 requires cafe boundaries to be delineated by a stationary, removable, wind-resistant enclosure between 42 and 48 inches tall, with no ropes or chains. To operate, § 22-73 requires the restaurant owner (and the property owner, if different) to file an application with the Department of Public Works including a scaled sketch plan, seating capacity, enclosure drawings, proof of insurance, and a Historic Preservation Commission certificate if required; permits run annually from May 1 through the following April 30 and must be renewed each year.

Section 22-74 requires commercial general liability insurance of $1,000,000 per occurrence and $2,000,000 aggregate naming the City as additional insured. The Director of Public Works may suspend a permit up to 30 days or revoke it outright for misrepresentation, repeat suspension, nuisance conditions, or a superseding public need, after written notice to the permit holder under § 22-76.
