Jackson, NJ Special Events & Permits: Sidewalk Dining & Cafés (2026)

Outdoor dining in Jackson Township is governed by the Mixed Use Neighborhood Center (MUNC) article, § 244-239, the walkable town-center overlay applied wherever a MUNC is a permitted principal use near the Route 526/527 corridor; the zoning ordinance does not extend a sidewalk-cafe permission to restaurants outside that overlay. Section 244-239B(7) lists establishments serving food or beverages, including walk-up windows and outdoor dining, among the permitted principal uses, but conditions that permission on maintaining adequate pedestrian access. The operative design standard, § 244-239K(3)(d), narrows that further for restaurants and coffee houses: they may utilize a portion of the sidewalk for outdoor dining, but a minimum clearance of 60 inches (five feet) must be kept open along the outside edge of the sidewalk for pedestrian passage at all times.

That clearance sits inside the same subsection K design standards that require ground-floor shopfronts to be at least 60% glazed and that let building elements, canopies and marquees project into required setbacks provided a 10-foot vertical clearance is kept over pedestrian ways. Because § 244-239K states its standards apply notwithstanding any conflict with the design and improvement standards elsewhere in the chapter, the 60-inch sidewalk rule controls over any more general setback or encroachment provision for a MUNC restaurant. The Planning Board reviews outdoor dining layouts as part of the site plan approval required for any MUNC development; there is no separate sidewalk-cafe license fee set out in the code.
