The record owners or lessees of a properly zoned restaurant abutting the public right-of-way space may, subject to the provisions of this chapter and the City of Rockford Outdoor Dining Design Guidelines adopted by Resolution by the City of Rockford City Council, and despite any provisions of this Code to the contrary, obtain a permit to operate a sidewalk cafe, on such space on which their properties abut as the city council determines is not needed for the use of the general public. For purposes of this chapter, a restaurant shall be any establishment which derives 40 percent or more of its gross income from the sale of food and nonalcoholic beverages.
