Albany, OR Special Events & Permits: Street Fair Rules (2026)

Street fair and festival vendors in the City of Albany, Oregon work under Chapter 13.33, Temporary Right-of-Way Use Permit. Section 13.33.010 covers the vendor activity by name: no person shall obstruct or make use of a public street, sidewalk, or other right-of-way for the purpose of display advertising, offering of services, food or other merchandise, or a promotional event without first obtaining a special event permit or road closure permit.

Standards for approval are in § 13.33.030. The City Manager reviews each application with consideration to existing laws and ordinances, and to disruption of, or hazards to safe vehicle and pedestrian movement, and authorizes those activities which will be permitted. If an application is denied, the applicant can appeal to the City Council.

Fees are in § 13.33.040, which says a fee will be charged for any permit which involves the promotion or sale of merchandise or services. The code text prints the fee amount as a blank placeholder, so the dollar figure is not stated in the code.

Permit term and revocation are in § 13.33.050. The permit is valid for the period specified on it and can be renewed annually, and it can be revoked or renewal denied for violation of conditions placed on the permit, or for any fraud or misrepresentation in the application.

Section 7.68.010(4) says no person shall use any street or sidewalk or any portion of it for the selling, storing, or display of merchandise or equipment, except as allowed by a special event permit or road closure permit, and § 7.68.010(6) requires an encroachment, special event or road closure permit to place a structure on or over a public street or sidewalk. Selling merchandise from a vehicle parked on a street is barred except in a duly licensed market place or when authorized or licensed under City ordinances (§ 13.21.030(13)(d)). Inside City parks, § 7.28.230 bars offering any article for sale, with an exception for a regularly licensed concessionaire acting under the authority of the parks and recreation director, and says vendor permits should be applied for at the time of park rental or along with the special event permit, sound permit, and/or road closure permit.
