Chapter 5.38 otherwise treats a craft fair or festival seller as an itinerant merchant, since Section 5.38.010(A) defines that term to cover anyone without a permanent place of business who sells from a temporary stand, tent, canopy or vehicle, which would trigger the annual license and ten-day cap set out in Section 5.38.020(A) and (B). Section 5.38.020(C) removes that requirement entirely for participants in an event the city manager or a designee recognizes, naming a craft fair, festival or bazaar as examples, but the exemption depends on that recognition existing rather than applying automatically to any gathering calling itself a festival.

Section 5.38.020(D) grants a separate exemption to charitable organizations and their representatives, conditioned on the city manager finding the group has lawful charitable purposes and issuing a written letter of exemption, which must stay available on the premises for inspection by police or other licensing officers. Because the definitions of temporary stand and tents, canopies and temporary membrane structures in Section 5.38.010 tie back to the Uniform Fire Code, an exempted vendor still needs to meet fire and building code standards even though the sales license itself is waived. No separate application, fee or standalone street-fair permit process appears anywhere in this chapter.
