Full Breakdown
07 makes it unlawful to sponsor, give, or participate in giving a public event in the city without a permit issued by the Public Event Committee. The application, filed through the Parks and Recreation Department, must reach the city at least 45 days before the event (new or recurring) and must state the applicant's name and address, the sponsor's identity, requested days and hours, a location description, anticipated attendance, requested city services, and a detailed site plan. The Committee approves a permit only if the event will not unreasonably interfere with neighboring property, public health, welfare, safety or recreation, is not reasonably anticipated to incite violence or disorder, will not demand extraordinary police expense absent a prior cost agreement, and the $50 application fee plus all facility/field rental fees are paid.
Organizers get one Public Event Application per fiscal year (October 1 to September 30) for recurring events unless dates, parking, site plan, or location change, which triggers a new application and fee. All event fees, including personnel and facility charges, must be paid in full within ten business days before the event. The applicant must furnish the City Risk Manager an insurance policy or certificate naming the City of Pompano Beach as additional insured, with coverage level set by the Risk Manager; the city itself carries no event insurance.
Within ten business days of receiving an application, the Committee must notify the applicant and City Commission of its decision in writing; the Commission can reverse an approval within ten working days by majority vote. A denied applicant may appeal in writing within ten days to the City Commission, whose decision is final. No single public event may run longer than ten hours in a calendar day or three consecutive calendar days, and no more than six public events per fiscal year are allowed per person or organization on city property, except athletic field tournaments and events the city or its Community Redevelopment Agency co-sponsors.
Violations & Fines
Sponsoring, giving, or participating in a public event without the required permit is an offense under § 98.07 and § 10.99, punishable by a fine up to $500, imprisonment up to 60 days, or both, with each day of continued violation a separate offense. Cancelling ten or more days before the event costs 25% of the paid application fees; cancelling less than ten days before forfeits the entire fee. Lapsed insurance not restored within 24 hours triggers permit revocation and the event must cease.
