New York Statewide Pool Barrier and Fence Standards

19 NYCRR Part 1228 incorporates the Residential Code Appendix V requiring barriers at least 48 inches high, with openings small enough that a 4-inch sphere cannot pass. Gates must be self-closing and self-latching with the latch at least 54 inches above grade. Pools installed after 2006 must include an audible alarm under Executive Law section 379. Localities must enforce these minimums uniformly across New York.

Missing or non-compliant pool barriers result in failed inspections, denial of certificates of occupancy, civil fines, and potential negligence liability if a child gains access and is injured.
