DeSoto enforces pool barrier requirements under the International Swimming Pool and Spa Code and Texas Health & Safety Code Chapter 757. All residential pools and spas with water depth of 24 inches or more must be enclosed by a barrier at least 48 inches high measured from the outside. The barrier must have no openings larger than 4 inches and no handholds or footholds a child could use to climb. Gates must be self-closing, self-latching, and open outward from the pool; latches must be at least 54 inches above the ground. Where a house wall forms part of the barrier, doors leading to the pool must have audible alarms (85 dB at 10 feet) that sound for at least 30 seconds when opened, unless a power safety cover is installed. Mesh safety fences meeting ASTM F2286 are acceptable. Above-ground pools with walls at least 48 inches high may use the pool wall as the barrier with a removable or lockable ladder.
Specific penalty amounts for this ordinance are not published in a publicly accessible fine schedule. Contact Desoto code enforcement directly for current fines, enforcement procedures, and hearing options.
