Section 6-212 requires a fence, wall, or solid structure at least 4 feet high completely surrounding any swimming pool, spa, or hot tub containing water over 24 inches deep. Openings may not permit passage of a 4-inch diameter sphere. Gates must be self-closing and self-latching with the latch in the upper quarter. Dwelling doors forming part of the enclosure are exempt from self-closing/latching. Existing fences between 3.5 and 4 feet may be repaired at the same height, but replacement of more than 50% triggers full compliance. A separate fence permit is required for pool enclosures.
Pool fencing violations are serious safety issues. Building inspection withholds final approval until compliance. Fines up to $2,000 per day.
