Section 8-42(a) adopts the International Swimming Pool and Spa Code, 2021 Edition, as the building code of the City of Kyle, with a certified copy filed with the building official under § 8-42(b) for permanent record and inspection, and § 8-42(c) applies the more restrictive provision if it conflicts with another part of the city's code. The zoning code's definitions section, § 53-5, distinguishes a "commercial" swimming pool open to the public for a fee from a "private" swimming pool built for the exclusive use of a single-family, duplex, multiplex, or multifamily dwelling's residents, and requires the private pool to be "located and fenced in accordance with city regulations" and not operated as a business or kept in a manner hazardous or obnoxious to neighboring property owners.

Section 8-103(4) sets a permit fee, from the fee schedule in Appendix A, for the construction or installation of a swimming pool, spa, or hot tub, plus a fee for each required inspection, which is when the building official checks the pool and its barrier for compliance with the adopted code. Section 8-48 requires whoever pulls that pool permit to be a valid registered contractor with the city, unless the applicant is the homeowner working on their own homestead.
