Under LBMC Title 18 and the California Building Code (CBC 3109.4.4), all private swimming pools or spas must be equipped with at least two drowning prevention safety features as required by the Swimming Pool Safety Act (HSC 115922). A permanent enclosure is required as one of the two features. The pool enclosure must consist of a fence, portion of a building, wall, or other approved durable enclosure. Doors, openable windows, and gates of living units shall not be permitted as part of the pool enclosure. The top of the barrier must be at least 60 inches (5 feet) above grade measured on the side away from the pool. Maximum vertical clearance between grade and the bottom of the barrier is 2 inches. Openings shall not allow passage of a 4-inch sphere. All pedestrian gates must be self-closing and self-latching with release mechanisms at least 60 inches above ground. Solid barriers must not contain climbable protrusions or indentations.
Failure to maintain required pool fencing is a serious safety code violation subject to immediate enforcement. Pool owners may face fines and requirements to install compliant barriers before the pool may be used.
