Under CBC Section 3109 and California Health & Safety Code Β§115920β115929, all residential pools and spas in Santa Paula must be enclosed by a barrier at least 60 inches tall. Gates must be self-closing and self-latching with the latch on the pool side at least 54 inches above grade. The barrier must have no openings that allow passage of a 4-inch sphere. Horizontal rails or members that could serve as footholds must be on the pool side. At least one of the following additional safety features is required: pool cover meeting ASTM F1346, pool alarm, or door/window alarms on all house doors opening to the pool area. Mesh pool fences meeting ASTM F2286 are acceptable. Existing pools must comply when substantial remodeling occurs or at property sale.
Non-compliant pool barriers are a serious safety violation. The building department will not issue a certificate of occupancy without compliant barriers. Existing non-compliant pools may be reported to code enforcement, resulting in orders to install barriers within 30 days. Failure to comply results in daily fines of $250+. Pool owners may face civil liability for injuries to children if barriers are inadequate.
