Swimming pool enclosures in Sunnyvale must comply with the California Swimming Pool Safety Act (Health and Safety Code 115920 et seq.) as adopted through the local building code. Any new or substantially remodeled pool or spa must have a barrier at least 60 inches high measured from the outside, with openings no more than 4 inches, and gates that are self-closing, self-latching, with the latch at least 60 inches above ground. In addition the owner must install at least two of seven approved safety features which include pool cover, door alarms on doors leading to the pool, self-closing interior doors, removable mesh fencing, or a pool safety alarm. Sunnyvale Building inspectors verify barrier compliance at final pool inspection and again during any permit work on doors or windows adjacent to the pool. Existing pre-1998 pools are grandfathered but most modern transactions trigger upgrades.
