Chapter 15.36 LEMC covers spas and hot tubs the same as pools: an outdoor hot tub or spa must have a barrier under LEMC 15.36.050. A 'spa' is recreational-bathing water over 18 inches deep within 160 square feet, serving no more than three families and their guests.
LEMC 15.36.030 applies the chapter to barriers for pools, spas and hot tubs serving no more than three families and their guests. LEMC 15.36.040 defines a spa as a recreational-bathing structure holding water over 18 inches deep with outside dimensions not exceeding 160 square feet, and defines a hot tub as a spa. LEMC 15.36.050 requires an outdoor pool, hot tub or spa to have a barrier, inspected and approved before plastering or filling. The same standards as pools apply: a 60-inch minimum height, a 2-inch maximum bottom gap, openings that will not pass a 4-inch sphere, and self-closing self-latching gates opening away (LEMC 15.36.050.A-C). An ASTM F1346-91 safety cover may serve as the barrier.
An outdoor hot tub or spa without a required barrier is correctable by the enforcement agency under Title 15 LEMC. Owners should confirm whether a portable spa's locking hard cover qualifies as an approved barrier before relying on it.
