Chapter 153 of the Hamden Code of Ordinances covers any "swimming pool," defined in § 153.01 as an enclosure for water with a minimum capacity of 1,000 gallons, so above-ground and in-ground pools that meet that threshold both need a permit. Section 153.02 requires anyone constructing or erecting a pool to first obtain a written permit from the Director of Health or a duly appointed inspector, and § 153.03 requires the application to be in writing, in the name of the property owner or the owner's agent, with information about the pool's construction and proposed location on a form the health department supplies.

Section 153.04 sets the fee at $5 per permit, payable to the health department for the town's use. Before any work begins, § 153.05 requires the Director of Health to approve the pool's plans, making it unlawful to construct, erect or commence construction of a pool in town without that approval and the written permit in hand. Section 153.06 then requires a final inspection by the Director of Health or the appointed inspector before the pool may be used. Location is restricted under § 153.07: a pool may only go where drainage is adequate so it does not create a public nuisance, and it cannot sit within 25 feet of a sanitary system or within 75 feet of a well.

Violating any of these requirements, including building without a permit or before final inspection, is punished under § 153.99 with a fine of not less than $5 nor more than $50.
