Under the Bergenfield Borough Code, refuse and recycling receptacles must be conveniently located on the premises and maintained to prevent the creation of a health nuisance. In dwellings of two units or fewer, tenants purchase and maintain receptacles only if stipulated by lease; otherwise, the landlord or owner is responsible. In buildings of three or more units, the landlord must purchase and maintain all receptacles. Recyclables must be empty and clean before placement, and recyclables cannot be bagged in plastic. Paper bags and cardboard boxes are prohibited as recycling receptacles, except for biodegradable yard waste bags.
Failing to maintain receptacles, using prohibited containers for recycling, or placing garbage in recycling bins can result in code enforcement summonses.
