Chicopee, MA Trash & Recycling: Bin Placement Rules (2026)

Section 169-10 of the Chicopee Code, titled Storage in tree belts, bans the storage of garbage, rubbish, refuse or recyclables of any kind on any tree belt, curb or public property unless the material sits in an approved standard legal container or an overflow bag. Four set-out rules follow. Containers go out no earlier than 12 hours before the scheduled collection day and must be out no later than 7:00 a.m. on collection day. They must sit on public property in a location accessible by City collection vehicles, and emptied containers must come off public property on the same day of collection.

The chapter's definitions explain what counts as a legal container: a City-provided toter, an overflow bag, or another yard waste bag or container the City specifically approves. Section 169-5(B) repeats the timing rule for garbage and adds that garbage is stored in watertight receptacles with tight-fitting covers made of metal or other durable, rodentproof material, with emptied containers returned to storage areas on the same day as collection. Under § 169-13(A), the cover on the toter must be reasonably closed for pickup to occur, and snow-coning of garbage in a toter is prohibited. Overflow bags are set out next to the toter.

Two other rules affect where the cart stands. Section 169-12(D) says City collection employees will not enter onto private property to make collections, so the toter has to be at the curb, tree belt or other public ground. Section 169-12(C) requires sidewalks to be kept free from obstruction and cleared of snow to the curbline. Owners of dwellings are ultimately responsible for their occupants' compliance under § 169-9(A), and occupants of each dwelling unit are responsible for proper placement of their garbage and rubbish under § 169-5(F).
