Clarkstown, NY Trash & Recycling: Bin Placement Rules (2026)

L. No. 11-2019, is specific about the container itself: all recyclables from one-family, two-family and three-family homes shall be placed in the designated plastic containers provided by the Town of Clarkstown for collection, removal and disposal, and recyclables shall not be placed in plastic bags for collection, removal or disposal. The subsection then adds an upkeep duty: the recycling container or containers must be kept clean and in such a place as not to constitute a nuisance or otherwise be objectionable, which reaches both the physical condition of the bin and where a resident stores it between collections.

This placement rule works together with Section 226-5G, under which ownership of set-out recyclables passes to the Town the moment they're placed at the curb, and with Section 226-8, which lets the Town Board or its authorized agents issue further rules on containers as needed. Because the container requirement is tied to the one-, two- and three-family category defined in Section 226-3, a four-or-more-unit building follows the separate nonresidential and multiple-residence program in Section 226-6 rather than this bin rule.
