NYC requires trash bins to be placed at the curb, not on the sidewalk, for collection. Bins must be set out no earlier than 8 PM (under new containerization rules) and retrieved by 9 PM on collection day. Bins cannot permanently occupy sidewalk space.
Under DSNY regulations (16 RCNY Β§1-04) and Admin Code Β§16-120, trash containers must be placed at the curb for collection and may not permanently block sidewalks. The new containerization rules being phased in require official DSNY containers in some areas. Bins must be set out no earlier than 8 PM the night before collection and retrieved by 9 PM on collection day. During non-collection periods, bins must be stored on private property (in a backyard, garage, or building interior). Permanently placing bins on the sidewalk violates the clear-path requirement of at least 8 feet (Admin Code Β§19-152). For buildings without adequate storage space, bins may be placed in front of the building on the sidewalk only during the designated set-out window. Large multi-family buildings may use DSNY-approved enclosures at the curb. Commercial establishments have separate rules for waste storage and cannot place refuse on the sidewalk before their designated set-out time.
