Each container provided as prescribed in this article shall be kept or placed in the following manner. On any premises adjacent to a dedicated, paved alley in a block with access to such alley at each end of the block, such containers shall be placed on or within two feet of the rear property line of such premises and shall be readily accessible for collection from the alley. ... B. Where such premises are not adjacent to an alley which is paved and dedicated, with access to such alley from each end of the block, each such container shall be placed on the curb in front of the premises occupied by the person placing the same, or on the curb at the side of the premises where such premises are adjacent to more than one street.

Full Breakdown

Section 13.20.140 answers where and when a container goes out. The default is that each container is kept on the premises of the person providing it. The exception is the day designated for collection: before the time collection starts in the district where the premises sit, the container is placed for collection according to the layout of the lot. This section sets no earlier set-out time, and residential collection itself cannot be made between 6:00 p.m. and 6:00 a.m. under § 13.20.120(F).

Alley lots come first under subsection A. Where the premises are adjacent to a dedicated, paved alley in a block with access to that alley at each end of the block, containers go on or within two feet of the rear property line and must be readily accessible for collection from the alley. The premises must be identified by street address, painted and maintained legibly in numbers not less than two inches in height, placed on each container or on a fence or other structure at the rear of the premises abutting the alley. The owner or occupant is responsible for this, and if they fail to comply the City can paint the numbers and charge the cost to the owner or occupant.

Curb lots follow subsection B. Where the premises are not adjacent to a paved and dedicated alley with access from each end of the block, each container goes on the curb in front of the premises occupied by the person placing it, or on the curb at the side of the premises where the premises are adjacent to more than one street, such as a corner lot.

Subsection C bars mixing: it is unlawful to put garbage or rubbish from your premises into a container holding waste from any other premises, or to set a container out in front of or behind another premises.

The get-back rule is in § 13.20.180. Anyone who places a container on a street, sidewalk, curb or alley for collection must remove it immediately after the contents are collected, and in any event within 12 hours after collection. Failing or refusing to do so is unlawful. Under § 13.20.160 the City can also refuse to collect waste that is not placed in the container or manner the article prescribes.

Violations & Fines

Leaving a container on the street, sidewalk, curb or alley more than 12 hours after collection violates § 13.20.180, which declares it unlawful. A violation is a misdemeanor under § 1.04.150 unless charged as an infraction, with infraction fines up to $100, $200 and $500 for a first, second and third conviction within a year. Each day is a separate offense. Chapter 1.08 administrative citations are also available, and missing alley address numbers can be painted by the City at the owner's or occupant's cost.
