03 puts the duty to supply containers on the city or its exclusive franchisee, who must provide every owner, tenant or occupant of a dwelling, and every proprietor of a hotel, restaurant, cafe or other business, a cart, bin or debris box for holding garbage, recyclables and organic waste between collection days. Placement is tightly controlled. Receptacles must be kept sanitary at all times by whoever occupies the premises, and located somewhere on the property that's readily accessible for pickup, but the code specifically bars leaving them within the limits of any street or other public place, or positioning them in a way that creates a nuisance.

Timing is just as specific: no bin, cart or bulky waste item can go out at the curb sooner than the day before the scheduled collection day, and nothing can be left out past the day of collection itself. Solid waste and recycling enclosures on a property are restricted to their intended use only, holding carts, bins or debris boxes for collection, and nothing else. If a customer overloads a container or racks up repeated contamination, the franchisee must issue at least three notices before it can charge a mandatory return-service fee or adjust the customer's service level, such as bumping up container size or collection frequency.
