Rather than routed curbside pickup, the ordinance requires the county to locate, maintain, and operate one or more landfills, or contract with other legally permitted solid waste handling facilities, and separately to locate, maintain and operate household garbage containers where individual residents deposit their own household garbage; the county then transports garbage from those containers to the landfill or another permitted facility. 290(A) creates a special solid waste district covering every residential parcel in unincorporated Hall County and bills each residence an annual fee, set by the board of commissioners, added directly to the property's ad valorem tax bill (or collected at manufactured-home permit renewal for homes not taxed as real property).
No fee is charged to a residence inside a municipality that already provides its own garbage service. 060 lets the board of commissioners adopt further rules to run the system day to day.
Violations & Fines
Nonpayment of the annual solid waste assessment is enforced the same way as delinquent ad valorem taxes, under O.C.G.A. § 48-2-44 and Title 48, Chapter 3, per section 8.60.290(C). Separately, dumping solid waste anywhere in the unincorporated county outside this system is unlawful under section 8.60.200, absent written approval from the board of commissioners.
