Hialeah, FL Trash & Recycling: Dumpster Rules (2026)

Section 78-108, 'General regulations,' is the operative dumpster-placement rule under Article IV, Supplemental Regulations for Garbage, Waste and Recycling Dumpsters. It applies, per Sec. 78-107, to new construction on multiple-family residential, commercial and industrial property, to condominium conversions, and to renovations requiring a building permit; existing nonconforming properties get 24 months to comply or may seek an administrative waiver under Sec. 78-111. Dumpsters must be kept in a location that is easily accessible to collectors and screened from public view, and can never be placed on a right-of-way, sidewalk or public property.

Every dumpster must sit inside an opaque, masonry-construction enclosure so it is not visible from the street or from abutting properties. The enclosure itself must be located no less than ten feet from any street right-of-way, and must respect visibility-triangle clearances: a 25-foot sight-triangle at street intersections and a ten-foot sight-triangle at driveway intersections. Construction standards in Sec. 78-109 add that enclosure walls must stand at least six inches taller than the dumpster and never less than six feet high, with a hard-paved base at least 24 inches larger than the dumpster on every side.

An administrative waiver under Sec. 00 application fee and is decided by the planning and zoning official, but is unavailable to new development or redevelopment projects.
