Kirkland commercial and multifamily properties can only store refuse in authorized garbage cans or detachable containers, kept at an established storage site rather than the curb whenever another collection point works. 075 applies to all commercial and other nonsingle-family residential premises. 120. Every owner or occupant must establish and maintain an on-site storage site for containers, and the city's planning and building department will not issue a building permit or certificate of occupancy for a commercial or nonsingle-family structure until a diagram showing the container storage location has been filed with the city; the contracted garbage collector must provide free technical assistance on designing that storage area if asked. Containers may be moved to the sidewalk, alley or street for pickup only when no other collection point on the property is feasible, and even then they cannot sit at the curbline, sidewalk, alley or street earlier than 30 minutes before the scheduled pickup, unless the container is an authorized litter receptacle meeting the state Model Litter Control Act and Department of Ecology rules.
080 adds that the path from the storage area to the loading point needs at least eight feet of unrestricted overhead clearance, and a storage site more than 25 feet from the public right-of-way can draw a monthly surcharge on the collection rate.
Violations & Fines
Violations of dumpster placement, storage-site, or timing requirements are enforced under KMC 16.08.125 through Chapter 1.12 code enforcement, carrying civil fines of $100 per day for days 1 through 15, $250 per day for days 16 through 30, and $500 per day beyond that, up to a $50,000 cap, with a 21-day right to appeal to the hearing examiner.
