All persons in possession of any place within the city shall store standard containers or commercial bins on their properties, when not placed for collection, in a manner which will be screened from public view and which will not allow such containers or bins to roll, fall or protrude onto the public streets, sidewalks or alleys of the city...An exemption may be allowed to the requirement that commercial recycling bins be stored in a manner which will screen them from public view in cases where existing trash enclosures do not allow adequate space to maintain two bins or in such cases where a commercial property has no existing trash enclosure...Any such exemptions will be evaluated at such time that a property owner files for a major entitlement or the buildings on the property are expanded over 50%.

The code carves out a narrow exemption from the screening duty specifically for commercial recycling bins: where an existing trash enclosure doesn't have adequate space for both a trash bin and a recycling bin, or where the property has no enclosure at all, the recycling bin doesn't have to be fully screened, though it must still be placed to minimize public visibility and can never be allowed to roll, fall or protrude into the right-of-way regardless of the exemption.
That exemption isn't permanent: the code directs the city to re-evaluate it whenever the property owner files for a major entitlement or expands the buildings on the property by more than 50%, at which point the city can condition approval on building a larger enclosure sized for both bins. 130.
Violations & Fines
A commercial bin that blocks or protrudes onto a public street, sidewalk or alley because of the responsible party's intent or negligence is a nuisance abatable under Section 1.01.250, and the responsible party, whether or not they own the bin, faces punishment under Section 1.01.200 et seq. Nonconforming or illegally hauled bins can be posted for removal and impounded by the city under Section 6.02.130, with the owner liable for removal, storage and disposal costs.
