North Hempstead, NY Trash & Recycling: Dumpster Rules (2026)

North Hempstead Code § 35-2B prohibits anyone other than Town agents or employees from placing a trash bin, dumpster or storage bin on a sidewalk, street, highway or other public place in the Town's unincorporated areas unless six conditions are all met: the bin carries at least one reflector per side, each at least six inches in diameter and visible at night; it has no defect or faulty design creating a public hazard; its placement will not block vehicular or pedestrian traffic; its use will not create offensive odors or a health hazard; it is conspicuously marked with the owner's name and address; and a permit for its placement has been obtained from the Superintendent of Highways and is conspicuously displayed on the bin.

Subsection C clarifies that the chapter does not bar placing a trash bin, dumpster or storage bin on private property where Chapter 70 (zoning) allows it, so the restriction is specifically about the public right-of-way. The provision was added by Local Law No. 9-1979 and works alongside § 46-9 of the Sanitation chapter, which requires every Dumpster or container used by a licensed hauler to display the hauler's name, telephone number and Town license number on an exterior side. Chapter 34's separate dumping rules also reach dumpster misuse: § 46-14G(2) makes it a violation to place waste in a dumpster designated for a different commercial or industrial establishment's use.
