Clay, NY Trash & Recycling: Illegal Dumping (2026)

Section 194-15 of the Town of Clay Code states that, except as specifically permitted elsewhere in Chapter 194, no hauler shall deposit, cause to be deposited, or store for more than one day upon any property any solid waste or recyclables, and it declares dumping of that material prohibited outright. The same section bars any hauler vehicle from allowing leachate or other obnoxious or contaminating substance to drain onto the public streets. The prohibition sits alongside § 194-16, which separately forbids letting solid waste accumulate on private property to the point it emits odors or becomes offensive or dangerous to public health, and § 194-17, which bars burying or burning solid waste within the town without written Town Board authorization.

Chapter 194, adopted September 18, 2000 by Local Law No. 1-2000, is enforced by the Town Code Enforcement Officer, Town Building Inspector, Town Fire Inspector, Highway Superintendent, Onondaga County Sheriff's Department, New York State Police and Department of Environmental Conservation officers under § 194-19C, with the Town Board able to seek a restraining order or injunction under § 194-19B. A hauler that dumps or stores waste on property, or lets leachate drain from its truck, is fined $100 per offense under the § 194-20 penalty schedule, with every day of continued violation charged as a new offense under § 194-19A.
