Faulkner County's unsanitary conditions ordinance defines 'illegal storage and handling' broadly: the possession of drums, polluted soils or other containment devices, plus the discharge, deposit, injection, dumping, spilling, leaking or placing of any waste onto land or into water, including groundwater, so that it can enter the environment or be released into the air, done without the permits required by the Environmental Protection Agency or the Arkansas Department of Environmental Quality. Under the operative list of unsanitary conditions, illegal storage or handling of any solid, liquid, household, automotive, commercial or demolition waste, whether dumped, spilled, burned or abandoned, on any lot in the unincorporated county is a violation regardless of whether the lot is occupied, vacant, improved or unimproved.

Enforcement follows the ordinance's standard process: the Sheriff gives written notice and 30 days to correct the condition, with a 15-day window for the responsible person to file a sworn grievance affidavit disputing the citation, before the case goes to the Prosecuting Attorney. §§ 8-6-401 through 416, so a dumper can face both the county's own misdemeanor charge and state litter-law consequences for the same act.
