Hendersonville, TN Trash & Recycling: Illegal Dumping (2026)

Title 17, Chapter 2 of the Hendersonville Municipal Code makes it unlawful for any person to dump, as defined in Section 17-204, any fill material, garbage, refuse or construction debris upon any public property, right-of-way, or private property within the City of Hendersonville. Section 17-204 defines 'dump' broadly as placing, discarding, or leaving fill material, garbage, refuse, or construction debris on any property, exempting only sites operating under a valid Fill Permit issued under Section 17-201. That permit is required before anyone fills or excavates a property, though it is waived for holders of a Grading or Building Permit filling under a building pad, sites moving less than 100 cubic yards, and normal grading or landscaping.

Permitted fill sites must post 'NO DUMPING' signs with 10-inch letters at intervals no greater than 150 feet under Section 17-206, and must fence the site with a substantial 5- to 6-foot fence with gates and post a sign reading 'DUMP DIRT AND ROCK ONLY AS PER CITY CODE, SECTION 17-201' at each access point under Section 17-207. Section 17-203 separately bars burning, burying, or accumulating construction debris on an individual job site, limiting any allowed 'workman's fire' to a 55-gallon drum used only between October and April, extinguished at day's end, and never fed treated lumber, cardboard, roofing, plastics, or PVC pipe.
