Overland Park, KS Trash & Recycling: Illegal Dumping (2026)

Municipal Code Chapter 13.24 targets dumping that damages, obstructs or interferes with a public street or drainage facility. Section 13.24.010 prohibits any person from dumping, depositing, washing or spilling leaves, debris, rubbish, or any other material in or on a street, sidewalk, bike-hike trail, right-of-way, gutter, storm sewer, water course, drainage course, or other public utility facility. It is separately unlawful to simply allow such material to remain there once deposited, so a property owner whose trash washes into a storm drain cannot wait it out.

The section explicitly makes each day the material remains in place a new, separately chargeable offense, which lets the City stack counts against someone who ignores a cleanup request. Enforcement runs through Section 13.24.020, which sends every violation to the general penalty track in Section 1.12.010 rather than setting its own fine schedule. That general penalty caps a first offense at a fine of not more than $500, imprisonment not to exceed six months, or both, and it independently treats each day a violation continues as a separate offense, stacking on top of the day-by-day rule already built into 13.24.010.

This dumping chapter traces to Ordinance DD-379 from 1966, amended by Ordinance DD-1659 in 1990, and was carried forward during a codification update citing K.S.A. 12-3015. It sits alongside the City's separate MS4 stormwater illicit-discharge rules, but 13.24 is the standalone street-and-drainage dumping offense that applies even where no stormwater permit is implicated.
