Full Breakdown
The core prohibition is short. Section 502.02(b), in the Police Regulations chapter on general offenses, says no person shall dump or deposit solid waste at any place within the city. It sits beside a rule against leaving abandoned ice boxes and refrigerators accessible to children, and police enforce it as a general offense.
Two other parts of the Code cover the same conduct from different angles. Section 405.02(3) declares a public nuisance any accumulation of tin cans, bottles, trash, uprooted tree stumps, logs, limbs, brush, cut vegetative debris or other debris, and the throwing, dumping or depositing of dead animals, manure, garbage, waste, decaying matter, ground, sand, stones, ashes, rubbish, tin cans or other material of any kind onto public or private property. Section 405.05 makes maintaining or causing such a nuisance unlawful. The community development director administers Chapter 405, except that nuisances affecting the public right-of-way or sanitary or storm sewer are enforced by the public works director. When the city uses its abatement process under § 405.07(a), the enforcing officer gives the owner or occupant written notice describing the nuisance and the steps to abate it, with a deadline not exceeding 30 days.
The stormwater illicit discharge section, § 803.03(f), adds two dumping rules. Subsection (f)(1) bars throwing, depositing, placing, leaving, maintaining or keeping any substance on a street, alley, sidewalk, storm drain, inlet, catch basin or other drainage structure, or on any public or private land, so that it might become a pollutant, unless the substance is in containers, recycling bags or another lawfully established waste disposal device. Subsection (f)(2) bars intentionally disposing of grass, leaves, dirt or landscape material into a water resource, buffer, street, road, alley, catch basin, culvert, curb, gutter, inlet, ditch or storm drain. The public works director is the principal official for enforcing § 803.03.
Violations & Fines
Unless the Code provides otherwise, § 102.01(a) makes a violation a misdemeanor with a fine not to exceed $1,000.00, imprisonment not to exceed 90 days, or both, plus costs of prosecution. The city can instead treat it as an administrative offense under § 102.01(c), where the Administrative Penalties schedule lists Illegal dumping at $150.00. Nuisance abatement costs can be collected under § 405.07 and § 102.01(c)(8).
