Downey, CA Trash & Recycling: Mandatory Organics Recycling (2026)

Downey Municipal Code Chapter 10 (Article V), added by Ordinance 21-1474 on December 14, 2021, makes organic-waste separation mandatory rather than optional. Section 5932 requires every Single-Family Organic Waste Generator to subscribe to the city's organic waste collection service for all organic waste generated, and the city can review the number and size of a household's containers and require the resident to adjust its service level. Section 5932(b)(1) sets the sorting rule itself: source-separated green container organic waste, including food waste, goes in the Green Container; source-separated recyclables go in the Blue Container; and everything else (Black Container Waste) goes in the Black Container, with a specific prohibition on putting Black Container material into either the Green or Blue Container.

9(c), but that is an addition to the subscription requirement, not a substitute for it; unlike commercial generators, single-family households have no de minimis or physical-space waiver option under Section 5934, which is limited to Commercial Businesses and Multi-Family Residential Dwellings. Section 5942 authorizes the city or its designee to inspect collection containers and vehicle loads to confirm compliance, though it may not enter the interior of a private residence. Section 5943 sets enforcement: a violation triggers a Notice of Violation from a Jurisdiction Enforcement Official (typically the Code Enforcement Division), and except for container-contamination violations, the resident gets 60 days from the notice to come into compliance before the city can pursue an administrative citation and fine, with the penalty amount set by City Council resolution. The city may also pursue civil action or prosecute a violation as a misdemeanor or infraction under other remedies allowed by law.
