Downey, CA Trash & Recycling: Dumpster Rules (2026)

Downey Municipal Code § 5222 governs commercial and construction bin placement citywide. Subsection (a) requires every Solid Waste Collector, including any solid waste enterprise applying for or holding a City encroachment permit, to apply for and hold a current City-issued annual Solid Waste Collector's Permit by July 1st each year, unless it already operates under a written Franchise granted under §§ 5218 or 5220. Subsection (b) ties that permit to real compliance obligations: the applicant has to pay an application fee and, if granted, a permit fee, follow the City Council's adopted fee schedule for service recipients, and meet standards on indemnification, minimum insurance and cash bonds.

Subsection (d) is the enforcement teeth: any person or entity that collects Commercial Solid Waste or Construction and Demolition Waste in the City, or that places a Commercial Bin or Construction Bin (the code's term for what most people call a dumpster or roll-off) anywhere in Downey, or simply permits one to remain, without first obtaining a City Franchise or permit, is guilty of a misdemeanor. The 'Bins' definition at § 5200 confirms this covers roll-off boxes and compactor bins with capacities of two, three, four, five, six cubic yards or larger used at commercial, industrial and construction sites, not just standard trash bins.

Because § 5222(d) treats every day of non-compliant placement as a separate offense, a contractor who drops an unpermitted roll-off for a multi-week job can accumulate a citation for every day the box sits on the property, on top of possible revocation proceedings against any hauler's permit under §§ 5224 and 5226.
