Violations of Chapter 12, Article IV (Solid Waste Disposal) and Article V (Yard Waste Collection) of the Apex Code are enforceable through the Town's Code Enforcement program. Setting out excluded items (hazardous waste, electronics, tires, construction debris, refrigerant appliances) for regular collection is a violation; GFL will leave the item and the resident may be cited. Improper set-out can also result in a missed collection with no return service unless the resident schedules and pays for a Bulk Item pickup. Illegal dumping is a Class 3 misdemeanor for the first offense under NCGS 14-399 (less than 500 lb) and escalates to a Class 1 misdemeanor for 500 lb or more or repeat offenses; commercial dumping is a Class I felony with civil penalties up to $5,000 under NCGS 14-399.4. Illegal dumping into stormwater conveyances or Jordan Lake tributaries adds NC DEQ enforcement under NCGS 143-215.6A with civil penalties up to $25,000 per day, and federal Clean Water Act exposure up to $66,712 per day (2024 adjustment).
