Section 6-2003(a) of the Commerce City Revised Municipal Code requires the owner or occupant of any property to have trash, garbage or waste removed at regular intervals, as often as necessary to prevent a public health nuisance, but the gap between collections can never exceed thirty days. Between collections, all trash, garbage and waste must be kept in watertight, corrosion-resistant containers with tight-fitting lids so it does not attract pests or spill. Section 6-2003(b) then sets curb timing for residential carts: containers may be placed at the curb on the morning of collection or the evening before, and must be pulled back to their storage area no more than twenty-four hours after the truck empties them, so bins do not sit streetside all week.

That same subsection requires residential containers to be screened behind a fence, in a garage, or by landscaping except while out for pickup. Because these are Chapter 6 nuisance provisions, a violation is a civil infraction under Section 6-1003, decided by a preponderance of the evidence in Commerce City Municipal Court or the city's administrative hearing process, and the city can abate a persistent violation and bill the property owner for the cost plus a fifteen percent administrative fee under Sections 6-1004 and 3-2103.
