Full Breakdown

Section 27-21 of the Jacksonville Beach Code sets the basic storage and collection rules. Residential and small commercial waste is stored and collected in residential and small commercial receptacles only. Multifamily and commercial waste goes in multifamily and commercial collection containers only, and any food waste or other putrescible material in those containers must be enclosed in waterproof bags that are securely closed. Section 27-1 defines the residential receptacle as a watertight container of not more than forty (40) or less than three (3) gallons with a tight-fitting lid and a weight not to exceed fifty (50) pounds, or a waterproof bag of the same capacity range that is not less than one (1) mill thick and securely closed.

Section 27-20 requires every owner of a residence, apartment or place of business to provide a container or containers with capacity to hold four (4) days' accumulation of solid waste. Pathological, hazardous and other dangerous waste is not collected by the city, so the occupant or owner must arrange safe disposal. Collection itself is done by the city's solid waste franchisee under Article III, and Section 27-27 requires residents, occupants and owners to have accumulations removed by that franchisee, with fees set by resolution of the city council.

The city manager and the public works director run the program under Section 27-16. Responsibility follows the occupant under Section 27-2, and Section 27-3 makes landlords furnish containers of sufficient capacity for every tenant in a furnished rental. A container that fails the standards is tagged by the city or the franchisee, and Section 27-21(g) lets the city or franchisee remove it from service if the party furnishing it does not do so within seven (7) days after written notice. Section 27-21(h) bars anyone from removing items from a container after deposit, except the city, the franchisee, the person who deposited the item, the owner or user of the receptacle, and police officers during an investigation.

Violations & Fines

None of the Chapter 27 sections quoted here prints its own penalty, so Section 1-11 applies: a fine not exceeding five hundred dollars ($500.00) or imprisonment for a term not exceeding ninety (90) days, or both, at the judge's discretion. Each day a violation continues is a separate offense, and a condition kept in violation is deemed a public nuisance the city can abate. Non-compliant containers are tagged and can be pulled from service.

Frequently Asked Questions

What kind of container do I use for household trash in Jacksonville Beach?
Section 27-21(a) says residential waste is stored and collected in residential receptacles only. Under Section 27-1 that means a watertight, lidded container of three to forty gallons weighing no more than fifty pounds, or a securely closed waterproof bag in the same size range that is at least one mill thick and of a type approved by the city.
Can someone take items out of my trash can after I put it out?
No. Section 27-21(h) makes it unlawful to remove any item from a solid waste container after it has been deposited for collection. The exceptions are the city, the franchisee, the owner of the item, the owner or user of the receptacle, and police officers or agents of the city, county and state during an investigation.
Does the city collect hazardous waste with the regular trash?
No. Section 27-21(c) says pathological waste, hazardous waste and any other dangerous waste as determined by the city shall not be collected and disposed of by the city. The occupant or owner is responsible for arranging disposal in a safe manner that follows the applicable rules and regulations.
Who is responsible for providing containers at a rental property?
Section 27-3 puts furnished rentals on the landlord, who must supply residential or commercial containers of sufficient capacity for all tenants. Where several occupants share collection containers, the premises owner, landlord or owner representative is responsible for the container, and the city keeps sole discretion over common-use containers.
