Full Breakdown

Section 27-27(a) of the Jacksonville Beach Code makes collection mandatory: all residents, occupants and owners of premises must have accumulations of solid waste and trash removed and disposed of by the city's solid waste franchisee, except for certain types of solid waste identified under the franchise contract. Fees are set by resolution approved by a majority of the city council and include the franchisee's charges, which can include a franchise fee cost, a fee for the amount delivered to the disposal facility and applicable taxes.

The Code does not print a collection weekday. Section 27-17 lets the city designate the area of each section of the city and the day or days of service, and publish rules that become part of the article and enforceable under it. Section 27-16 places the control and removal of refuse under the city manager, the public works director or their designated representative.

Holidays are handled by § 27-28. The franchisee is not required to pick up on the city observed New Years Day, Thanksgiving Day, Christmas Day or any other holiday listed in the franchise contract when one falls on a regularly scheduled pick up day, but it must collect on the holiday or the following day, excluding Sunday.

Section 27-29 puts service hours in the franchise contract and puts the burden on the customer: waste must be in approved receptacles at the appropriate location for collection before 7:00 a.m. on the appropriate collection day. Section 27-30(a) requires customers to place receptacles at the curbside unless the franchisee agreed to a special service location. The curbside collection point defined in § 27-1 is the area on or adjacent to the driveway within five (5) feet of, and in no case more than ten (10) feet from, the street or roadway, and not on the driving surface or in the drainage gutter, swale or ditch.

Capacity rules back up the schedule. Section 27-20 requires containers large enough to hold four (4) days' accumulation of solid waste. Under § 27-30(b), yard waste capable of being containerized goes in an approved receptacle, tree trunks, stumps, limbs, trimmings or waste building material cannot exceed six (6) inches in diameter or five (5) feet in length, and the franchisee is not required to collect yard waste that does not comply. Under § 27-21(f), noncombustible refuse is collected in amounts not to exceed one cubic yard per week.

Violations & Fines

Chapter 27 prints no separate fine for missing a pickup window. A receptacle that fails the standards is marked, must be removed from service by the person furnishing it before the next scheduled collection day, and is removed by the franchisee or another city representative if that person does not after written notice (§ 27-30(c)). Yard waste outside the size limits is not collected. Where an act is made unlawful and no specific penalty is printed, § 1-11(a) sets a fine not exceeding $500.00 or imprisonment not exceeding ninety (90) days.

Frequently Asked Questions

What time must trash be out in Jacksonville Beach?
Section 27-29 makes it the customer's responsibility to place solid waste material in approved receptacles at the appropriate location for collection before 7:00 a.m. on the appropriate collection day. The hours the franchisee actually works are set in the city's solid waste franchise contract rather than printed in the Code.
What happens to pickup on holidays?
Section 27-28 says the franchisee does not have to pick up on the city observed New Years Day, Thanksgiving Day, Christmas Day or any other holiday listed in the franchise contract when it falls on a regularly scheduled pick up day. The franchisee must collect on the holiday or the following day, excluding Sunday.
Who decides my collection day?
The city. Section 27-17 allows the city to designate the area of each section of the city and the day or days of service, and the rules it publishes become part of the article and enforceable under it. The Code itself prints no weekday, and Section 27-16 places solid waste functions under the city manager and public works director.
Where do I put the cans for collection?
At the curbside, unless the franchisee agreed to a special service location (§ 27-30(a)). Section 27-1 defines the curbside collection point as the area on or adjacent to the driveway within five (5) feet of, and no more than ten (10) feet from, the street, and not on the driving surface or in the drainage gutter, swale or ditch.
