Full Breakdown
Jacksonville Beach does not write curbside recycling as a stand-alone program in its Code. Chapter 27 instead names recyclables alongside every other waste stream and hands the operating details to the city. Two sections carry the requirements.
Section 27-2 fixes responsibility. In enforcing the chapter, every occupant of premises where rubbish, refuse, solid waste, yard waste, recyclables, noncombustible refuse, construction and demolition debris, industrial waste, hazardous waste or pathological waste originates, whether landlord, owner, tenant, sub-tenant or custodian, can be deemed responsible and subject to the chapter. An owner or landlord letting the whole of a house or premises, apartment or housekeeping room is not responsible for the act or default of the occupant holding under that owner or landlord. Occupancy means the person in control of the actual premises from whom the material originates.
Section 27-17 gives the city the operating authority. The city can designate the area of each section of the city for the control and removal of recyclables and the other listed waste, designate the day or days of service, and make and publish rules and regulations for the sanitary accumulation and handling of the material and for the type and location of containers. It can provide for the loan or use of containers and establish containers for common use in any business district on private or public property. Those rules and regulations become part of the article and are enforceable under it.
What the Code does not print matters for a resident. It sets no recycling collection weekday, no recycling bin size, no sorting rule and no recycling fee. The recyclables definition in § 27-1 points to the approved recycling list, and the rules a household follows are the ones the city designates and publishes under § 27-17. The mandatory collection and fee provision in § 27-27(a) speaks of solid waste and trash, not recyclables.
Violations & Fines
Chapter 27 prints no penalty clause aimed at recyclables. The city's published rules become enforceable as part of the article under § 27-17, and the tagging and seven (7) day removal procedure in § 27-21(g) names recyclables containers. Where an act is made unlawful and no specific penalty is printed, § 1-11(a) sets a fine not exceeding $500.00 or imprisonment not exceeding ninety (90) days, with each day a separate offense.
