Full Breakdown
Section 27-30(b) is the operative yard waste rule for residential and small commercial customers. Yard waste capable of being containerized is placed in an approved garbage receptacle. Tree trunks, stumps, limbs, trimmings and waste building material cannot exceed six (6) inches in diameter and/or five (5) feet in length. Receptacles and piles sit in general not more than five (5) feet, and in no case more than ten (10) feet, from the street or roadway, and never on the driving surface or in a drainage gutter, swale or ditch.
Section 27-1 defines yard waste as leaves, grass cuttings, shrubbery cuttings and other refuse from the care of lawns, gardens, shrubbery, vines and trees, and it excludes dirt, soil or sod removed in renovating lawns and also excludes limbs and cuttings over six (6) inches in diameter or five (5) feet in length. A yard waste receptacle is a can or plastic bag with a capacity not in excess of forty (40) gallons and enough strength to hold its contents while being lifted. Section 27-21(e) adds that limbs, shrubbery cuttings and the like over three (3) feet in length or four (4) inches in diameter are stored and collected in neat piles, and that palm fronds do not need to be reduced in size.
Section 27-22 forbids depositing yard waste on an adjoining lot, a street, plaza, alley or park, or in any canal, waterway, lake or pool. Section 27-26 puts excessive amounts of grass, sod, tree limbs, cuttings or dirt on the owner or contractor at their own expense, and the city decides what counts as excessive. Collection is performed by the city's solid waste franchisee, and the fees are set by city council resolution under Section 27-27.
Violations & Fines
The franchisee is not required to collect yard waste that does not meet Section 27-30(b), so oversized or misplaced piles stay at the curb. Depositing yard waste on another lot, street, alley, park or waterway is unlawful under Section 27-22. Where a section prints no penalty, Section 1-11 sets a fine not exceeding five hundred dollars ($500.00) or imprisonment not exceeding ninety (90) days, with each day a separate offense.
