Section 4312(a)(1) requires the owner, occupant or other person responsible for any premises in Tustin to arrange with a contracted hauler for collection of municipal solid waste and divertable materials. Section 4312(a)(2) then makes it unlawful to fail or neglect to provide for removal of the waste the premises generates, treating each day of noncompliance as a separate offense, and Section 4312(a)(3) declares any unauthorized accumulation of solid waste or divertable materials on a property a public nuisance in its own right. Section 4312(b)(1) sets the baseline frequency: solid waste and divertable materials must be removed from a Tustin premises at least once each week.

Two categories can be collected less often unless the City says otherwise, per Section 4312(b)(2): temporary containers at construction or demolition sites holding no food scraps or yard trimmings, and recyclables containers holding no food scraps, food soiled paper or yard trimmings. Section 4312(b)(3) lets the County Health Officer or the City require more frequent removal if conditions warrant it, and materials must go through the City's contracted hauler under the franchise voters approved by Initiative Ordinance No. 2006-01 in November 2006, since Section 4312(a)(1) requires hauler arrangements rather than self-service disposal for most premises.
