HMC 6.08.020 lists the City's core solid-waste offenses, and two of them govern recycling specifically. Subsection C bars any person from mixing source separated recyclable material with solid waste in any vehicle, box, container or receptacle used in solid waste collection or disposal, so a resident or hauler cannot recombine what has already been separated for recycling. Subsection N separately requires generators to prepare source separated recyclable materials properly, according to educational materials and instruction from a collection or drop box franchisee, the City or its agents, meaning the specific sorting rules come from your franchisee's published guidance rather than a single citywide list in the Code. Subsection A backs this with an anti-scavenging rule: no person may take recyclable material set out for franchisee collection without the owner's or generator's permission.

The recycling duty has a narrow carve-out in HMC 6.08.025(A): material that a generator source-separates and then sells or exchanges directly for fair market value, rather than setting it out for franchisee collection, falls outside HMC 6.08.020(A) through (D). Recyclable material itself borrows the state-law definition incorporated by HMC 6.08.015, which points to ORS 459.005 as enacted.

Violations of the subchapter are enforced under HMC 6.08.060: the City may cite by administrative process or municipal citation, and a person cited may appeal to the City Manager within 10 days of the citation under HMC 6.08.060(D). Rate criteria the finance committee reviews under HMC 6.08.040(C)(9) explicitly include profit or cost savings resulting from recycling, tying resident compliance to the franchise rate structure.
