Solid waste collection in Hillsboro runs entirely through franchises the Council awards under HMC 6.08.030; HMC 6.08.020(D) makes it unlawful for anyone to provide solid waste management and collection services or drop box services within the corporate limits of the City, or advertise for the performance of those services, without obtaining a franchise from the City. Once a franchise is granted, HMC 6.08.050(B) turns collection into a mandatory service obligation: each franchisee shall provide service to any customer within the service area of that franchisee upon request at the rates established pursuant to HMC 6.08.040, unless the customer is exempt under standards the Council adopts by resolution.

A franchisee that violates the subchapter faces escalating civil penalties under HMC 6.08.055(A): up to $500.00 for a first violation in a 12-month period, up to $750.00 for a second, and up to $1,000.00 per violation for a third and later violation, assessed per day or per occurrence. Five or more violations in a year, or a fraud finding, can trigger franchise revocation. A customer or franchisee cited under the subchapter may appeal to the City Manager within 10 days of the citation under HMC 6.08.060(D).
