(a)All recyclables, once placed at a collection location or in a recycling container at a collection location, become the exclusive property of the City and/or its collection franchisee as established in a franchise agreement; provided, however that this provision does not apply to commercial enterprises which store materials on the business location and have an ongoing program of reusing materials or marketing such materials to purchasers of the materials.(b)Recovery of recyclables from any solid waste generated or brought within the City must occur prior to the placing in a recyclable container at a collection location and such recovery shall be subject to State and local public health and safety laws.(c)It is the franchisee's duty and responsibility to ensure that all items collected as recyclable material are, in fact, recyclable, or contain only de minimus non-recyclable material.

Full Breakdown

Sec. 41-16 of the Palm Coast Code of Ordinances governs what happens to recyclables once they leave your hands. Under subsection (a), any recyclable material placed at a collection location or in a City-issued recycling container becomes the exclusive property of the City and its franchisee, with a narrow carve-out for commercial businesses that store and resell their own recyclable materials on site as an ongoing operation. Subsection (b) requires that any recovery of recyclable material from mixed solid waste happen before that material is placed in a recycling container, and subjects that recovery to State and local health and safety law. Subsection (c) puts the burden on the franchisee to ensure that whatever it collects as recyclable material is actually recyclable, or contains only a de minimis share of non-recyclable material.

Sec. 41-7(a)(1)b requires every solid waste or recyclable collection franchisee operating in the City to provide full recycling services, including glass, plastic, aluminum and cardboard, to both residential and commercial customers; a franchisee cannot offer trash pickup without also offering recycling. Recyclables follow the same curb-placement and timing rules as household trash under Sec. 41-17(a)(5): containers cannot go out earlier than 6:00 p.m. the night before collection or stay at the curb later than 6:00 a.m. the day after pickup. Sec. 41-17(a)(7) separately prohibits removing recyclables or solid waste from a container, garbage can or recycling bin at a collection location or curbside without authorization, a provision aimed at scavenging and bin theft.

Violations & Fines

Taking items back out of a recycling bin without authorization, or a franchisee failing to run a full recycling program, are prohibited acts under Sec. 41-17(a)(7) and Sec. 41-7(a)(1)b, punishable to the maximum extent under Florida Statute 162.22 per Sec. 41-18. Vandalizing or removing recycling containers themselves is a separate violation under Sec. 41-17(a)(21).
