Full Breakdown

Sec. 010 defines 'green waste,' also called 'yard waste,' as a form of solid waste composed of leaves, grass clippings, brush, branches and other forms of organic matter generated from landscapes, farms and gardens, and scrap wood, separated from other forms of solid waste, but it expressly excludes large stumps or branches and yucca or palm fronds because they are not suitable for composting. Sec. 112 then bars commingling: green waste cannot be placed in a container designated for the collection of any other form of solid waste, meaning it must go in its own green waste container under the franchised hauler's system rather than the black trash cart.

Two exemptions from the general franchise-hauler requirement apply specifically to yard waste under Sec. 040(B): green waste generated by an agricultural use permitted on the lot needs no franchised hauler at all, and yard waste removed from the premises by a gardening, landscaping, or tree trimming contractor as an incidental part of the total service offered by the contractor likewise bypasses the franchise system. Multi-family dwellings of five or more units and qualifying commercial premises must additionally arrange organics diversion service for their green waste under Sec.

054, consistent with the state's organic waste diversion mandate implemented locally in Ch. 05. Green waste containers otherwise follow the same placement, timing and maintenance standards set for all solid waste containers under Sec. 070, including the curbside set-out window described in the city's collection rules.

Violations & Fines

Placing green waste in a trash or recycling cart violates Sec. 9.04.112 and, like other Ch. 9.04 violations, is punishable under the code's general penalty in Sec. 1.12.020: a misdemeanor carrying up to a $1,000 fine, up to six months in jail, or both, with continuing noncompliance counted as a new violation each day. Contaminated green waste containers can also be rejected by the franchised hauler, leaving the responsible person liable for separate disposal.
