Section 52-2.7, added 5-2-05 by Ord. No. O-5-2005-019 and amended 8-28-06, prohibits sweeping, raking, blowing or otherwise placing yard waste that is not containerized at the curb or along the street. Placement at the curb or along the street at any other time or in any other manner is a violation. If it happens, the party responsible for the placement must remove the yard waste from the street or is deemed in violation.
Definitions in § 52-1.2 fix what the rule covers. Yard waste means leaves and grass clippings. Containerized means placement of yard waste in a brown, biodegradable bag which can be obtained from the Department of Public Works, so that yard waste does not spill or blow out into the street and come into contact with stormwater. Leaves are fallen leaves excluding brush and grass clippings. Brush is defined separately as branches, woody plants and like vegetative material that does not exceed five inches in diameter, and Christmas trees.
Section 52-2.8 extends the prohibition to lawn care and landscaping workers. The owner or occupant of any property, or any employee or contractor engaged to provide lawn care or landscaping services, cannot sweep, rake, blow or otherwise place yard waste in the street unless it is containerized, and the responsible party must remove any non-containerized yard waste placed there. Leaves and brush also appear on the § 52-1.2 list of designated recyclables, and § 52-2.1 makes it unlawful to put designated recyclables in a trash receptacle bound for a landfill or resource recovery site.

Violations & Fines
A violation of § 52-2.7 or § 52-2.8 is a violation of Chapter 52. Under § 52-4, a firm, entity, organization, association, business, corporation or company, which covers a landscaping contractor, is fined not less than $50 nor more than $500, and a residential property owner is fined not more than $25. The Recycling Coordinator can issue warnings and notices of violation with orders to pay penalties.
