§ 193-02 Escape of Water Prohibited. The Utility Division's liability rules reinforce where responsibility sits: under § 193-01, the city is not liable for damage caused by a break or leak in any water pipe inside the curbline, meaning the customer's own service line, from the curb stop to the structure, is the customer's responsibility to keep sound.
At water-service application, § 193-21(D) requires the customer to sign a waiver of claims against the city for damage from leaks in or failure of the customer's own water system at turn-on. During a declared water emergency, § 193-49(F) goes further and makes the known escape of water through defective plumbing strictly prohibited outright, on top of the general year-round ban in § 193-02.
Violations & Fines
Violating § 193-02 or § 193-03 is punishable under the general penalty at § 193-99: any person violating a provision of Chapter 193 not otherwise assigned a specific penalty is guilty of a class 1 misdemeanor, subject under § 10-99 to a fine of up to $1,000, imprisonment for up to ten days, or both. The city can also act through its utility powers rather than the courts: § 193-29(B)(2) lets the Utility Division discontinue water service without notice wherever a dangerous condition is found on the customer's premises and the customer refuses to correct it, and § 193-29(B)(3) otherwise gives a customer 48 hours after written notice to fix a cited violation before service is cut.
