Affordable units must comply with the Uniform Housing Affordability Controls, 13 percent of them must be restricted for very-low-income households, and affordability controls run at least 30 years from initial occupancy.
Violations & Fines
Under § 432-7, a designated City official gives the developer written notice specifying the violation and requiring corrective action within 30 days. If the developer does not correct it in time, the developer is fined up to a maximum of $2,000 a day for each violation that continues after the notice until it is corrected. Section 432-6(K) also bars payment in lieu of building affordable units on site, except for fractional units.
