Park Fees. For accessory dwelling units of 750 square feet or more, a proportionate amount of Park Land Dedications and In-Lieu Fees shall be paid, based upon the City's adopted Development Impact Fee Schedule.

16. Objective Design Standards. Accessory dwelling units or junior accessory dwelling units shall incorporate the same architectural features, building materials, and color as the main dwelling unit on the property. These features shall include, but are not limited to, roofing material, roof design (i.e., slope, style), fascia, exterior building finish, color, exterior doors, windows, garage door, and architectural enhancements. When an existing garage is converted into a JADU/ADU, the existing garage door, if visible from public or private right-of-way, shall be eliminated and replaced with a wall, windows, door, or other exterior design features which are architecturally consistent with the exterior design of the structure and the main dwelling. Second story windows and glass doors shall be located to retain privacy between properties through such methods as offset or clerestory placement, use of opaque or view-obscuring glass.

Full Breakdown

Buena Park Municipal Code § 19.348.010(C)(15) requires a proportionate Park Land Dedication and In-Lieu Fee for accessory dwelling units of 750 square feet or more, calculated off the City's adopted Development Impact Fee Schedule. Smaller ADUs and JADUs (under 750 square feet) are exempt from this fee, consistent with the state-law cap on impact fees for sub-750-square-foot ADUs. The fee applies citywide wherever an ADU of that size is permitted, on top of standard building permit fees.

Violations & Fines

Failure to pay the assessed park fee before permit issuance will hold up the building permit; the Community and Economic Development Department calculates the amount from the adopted fee schedule at application.
