Oceanside, CA Animal Ordinances: Bird Protection (2026)

City Code Sec. 5 sets a hard 35-foot buffer: no one may keep or feed chickens, ducks, geese, turkeys or other fowl within 35 feet of any dwelling other than the fowl owner's own house, though fowl may be kept temporarily where they are lawfully bought and sold at a shop or business. Sec. 6 separately targets nuisance behavior: anyone keeping hens, ducks, geese, other domestic fowl, or rabbits may not let them go or be at large on a neighbor's premises without that neighbor's consent, and may not keep them in a way that is offensive or annoys people living nearby, regardless of distance.

Together the two sections cover both the physical setback for a coop or pen and the ongoing nuisance standard for birds that wander or smell. Code enforcement and animal control (state humane officers, the police chief, peace officers, and health officers) may enter private property under Sec. 2 to investigate a suspected violation of this chapter after issuing a warning notice or citation. There is no separate wild-bird or migratory-bird protection ordinance in the Oceanside City Code; the chapter regulates domestic fowl-keeping, not harm to wild birds, which falls under state and federal law (Penal Code Sec. and the Migratory Bird Treaty Act) rather than city code.
